GOVERNING LAW

1.1 These Terms, Policies, Agreements, and all services, products, consultations, installations, software services, internet services, cyber services, networking services, and related activities provided by Loopcore Enterprises shall be governed by and construed in accordance with the laws of the Republic of Kenya.

1.2 Any dispute, claim, complaint, or controversy arising out of or relating to our services, products, website, policies, agreements, or business relationship with Loopcore Enterprises should, where reasonably practicable, first be addressed through good-faith discussions between the parties with the aim of reaching an amicable resolution. Either party may initiate such discussions by providing notice to the other party through any reasonable communication channel.

1.3 Where a dispute cannot be resolved amicably within thirty (30) days from the commencement of good-faith discussions, either party may refer the matter to the competent courts of Kenya, which shall have jurisdiction over the dispute unless otherwise required by applicable law.

1.4 Nothing in this section shall prevent either party from seeking urgent, interim, equitable, injunctive, or protective relief where reasonably necessary to protect legal rights, property, confidential information, intellectual property, network infrastructure, service integrity, unpaid service charges, or other lawful and legitimate interests.

1.5 If any provision of these Terms, Policies, Agreements, or related documents is found to be invalid, unlawful, or unenforceable, such provision shall, where possible, be modified and enforced to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

1.6 The failure or delay of either party to enforce any right, remedy, or provision under these Terms shall not constitute a waiver of that right, remedy, or provision unless expressly agreed in writing by the party granting the waiver.

1.7 Unless otherwise ordered by a court of competent jurisdiction or required by applicable law, each party shall bear its own costs and expenses associated with the investigation, negotiation, and resolution of any dispute.

1.8 This Governing Law section shall survive the termination, suspension, expiration, cancellation, or completion of any service, agreement, transaction, or business relationship between the parties.

1.9 References to services, products, agreements, policies, websites, systems, or business activities shall include any current, future, modified, replacement, or supplementary offerings provided by Loopcore Enterprises unless expressly stated otherwise.
